She also advises employers with respect to due diligence defenses and workplace inspection and injury prevention issues, her specialty
Me Lambert’s first years of practice within the legal department of the Commission des normes de l’équité de la santé et de la sécurité du travail (CNESST) provides her with an invaluable inside edge and truly exceptional insight and expertise in matters relating to inspection-prevention issues, ranging from correction and violation notices, to the penal and criminal prosecutions increasingly initiated by the CNESST’S inspectors and various CNESST Regional offices under both the Regulation respecting health and safety and the new provisions of the Criminal Code of Canada laying down redefined mandatory obligations and criminal responsibility on Directors and all levels of Management personnel in matters of injury prevention and health and safety activities.
She is highly regarded by her peers for her exceptional knowledge of the complex internal operations of the CNESST and it’s requirements in matters of « due diligence » allowing employers to constitute a valid defense against penal and criminal prosecutions. This particular advantage helps her obtain advantageous settlements and reduced fines for her clients generating important savings in time, effort, risk and money.
In claims management and workers compensation matters, our clients greatly appreciate her wealth of experience before the Tribunal administratif du travail (TAT), as well as her practical, well grounded and efficient common sense approach with the compensation agents and other CNESST decision makers.
